C-FEJL, an Embraer ERJ-170-200 aircraft operated by Sky Regional Airlines, was conducting flight SKV7707 from Toronto/Lester B. Pearson Intl, ON (CYYZ) to Austin-Bergstrom Intl, TX (KAUS) with 4 crew members and 62 passengers on board. Shortly after becoming airborne from CYYZ, the flight crew received an EICAS SPOILER CONTROL FAULT followed almost immediately by a WING SHEAR caution message. The flight crew advised ATC and declared an emergency while levelling the aircraft at 5000 feet ASL. QRH procedures were executed and the cabin crew was notified that they were returning to CYYZ. The landing was uneventful with ARFF standing by. The operator’s maintenance checked the flight spoiler operation and found no faults. The main landing gear was serviced due to the overweight landing and the inspection revealed no faults.
The aircraft was returned to service.
